Copyright, patents and your business

Learn how copyright, patents and trade marks differ and find official Indian filing resources.

At a glance: Copyright in an eligible original work arises automatically; registration is optional evidence. An Indian patent, if granted and maintained, ordinarily lasts 20 years from filing and is territorial. A public disclosure before filing can affect novelty. IP India copyright basics · patent basics. Identify what you want to protect

  • Copyright generally protects original expression such as written content, artwork and software code; it does not protect an idea by itself. The Indian IP office says copyright arises automatically for eligible works; registration is not mandatory but can provide evidence in a dispute. Check ownership and permissions, especially for work created by employees, contractors or collaborators. Copyright basics.
  • Patents concern qualifying inventions. An invention must meet legal tests including novelty, inventive step and industrial applicability, and must not fall within excluded categories. A filed application is not the same as a granted patent. Patent basics.
  • Trade marks may protect brand identifiers such as names and logos; they are distinct from copyright and patents. Search and assess the relevant mark and classes before investing heavily in a brand. IP India services.

If you have a possible invention

1. Document the inventors, development and existing agreements, and identify who owns the rights.

2. Avoid public disclosure before obtaining qualified advice: disclosure can affect novelty and the ability to obtain protection.

3. Search existing patents and other public information; discuss patentability, costs and territories with a registered patent agent.

4. If proceeding, use the official patent filing information and track examination, deadlines and fees. Protection is territorial; an Indian patent does not automatically protect an invention worldwide.

If you create content or software

Keep dated records and licences, clarify ownership in written agreements, and obtain permission for third-party material. If registration is useful, review the official copyright filing steps and current fees.
